How trading income is taxed ट्रेडिंग पर कर
For tax year 2026-27. How you trade decides which head of income it falls under, the rate, and what you can do with a loss.
| Type of trade | Treated as | Tax rate | If you make a loss |
|---|---|---|---|
| Delivery shares and equity funds, held up to 12 months | Short-term capital gain | 20% | Set off against any capital gain; carry forward 8 years |
| Delivery shares and equity funds, held over 12 months | Long-term capital gain | 12.5% on gains above ₹1.25 lakh a year | Set off only against long-term gains; carry forward 8 years |
| Intraday equity | Speculative business income | Your slab rate | Set off only against speculative income; carry forward 4 years |
| Futures and options | Non-speculative business income | Your slab rate | Set off against other income except salary; carry forward 8 years |
What traders often miss
- Losses carry forward only if you file on time. Miss the due date and a trading loss can’t be carried to next year. F&O and intraday traders file ITR-3, due 31 August if no audit is needed.
- F&O turnover is not your contract value. It is the total of absolute profits and losses on each trade. This number decides whether a tax audit applies.
- Tax audit applies when business turnover crosses ₹1 crore, or ₹10 crore if nearly all your receipts and payments are through banks. Other situations can also trigger it; check your case before filing.
- Expenses count against F&O profit: brokerage, STT, exchange charges, internet and data, and research subscriptions, if you keep records.
- Advance tax applies to trading profits too. Missing it means interest, even if you pay in full at filing.
- Share buybacks are taxed as capital gains in the shareholder’s hands from 1 April 2026.
